Terms of Use
These Terms of Use ("Terms") are an agreement between you and BharatAI Solutions Private Limited ("QwikExit", "we", "us"), a company incorporated in India with its registered office at C-24 Shaha Dana Colony, Izzat Nagar, Bareilly, Uttar Pradesh 243122, India. They apply to the QwikExit shopper app, our website qwikexit.com and scan-and-pay checkout in partner stores (the "Service"). Retailers using the Retailer Console and store apps are also bound by our Retailer Terms.
By creating an account or using the Service you agree to these Terms, our Privacy Policy, Refund & Cancellation Policy and Acceptable Use & Fair Exit Policy. If you do not agree, please do not use the Service. These Terms are an electronic record under the Information Technology Act, 2000 and do not need a signature.
The key points
- QwikExit is a technology platform. You buy the goods from the store, not from us. The store sets prices and offers, issues the GST invoice and handles returns.
- Scan every item you take, pay before you leave, and show your exit pass to the store staff. They may check your bag.
- You must be 18 or older to have an account.
- The optional Pro plan renews monthly until you cancel; cancel any time in the app.
1. What the Service is
QwikExit lets you scan products with your phone in participating stores, see your bill, pay online (or at the store's counter, where offered) and leave the store by showing a signed exit pass, without queuing at a billing counter. It also shows partner stores near you, offers from partner stores and brands, and your receipts.
For purchases in a store, QwikExit acts as an intermediary and technology service provider to the retailer under the Information Technology Act, 2000 and as a technology platform for the retailer's sale; the retailer is the seller under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020. The retailer's name and address, and the GST details on its invoice, are shown in the app and on the receipt. We do not own, stock, price or sell the goods and are not a party to the sale contract, but we will help you with any problem (section 9).
2. Eligibility and your account
- You must be at least 18 years old and able to enter into a contract under the Indian Contract Act, 1872. Children may shop at the store's normal billing counter, or under the supervision of a parent or guardian using the adult's account.
- The Service is offered only in India.
- Sign in with your email (we send a one-time code), Google or Apple. Give accurate details and keep your phone, email and codes secure. You are responsible for activity on your account.
- One account per person; do not share it or create accounts for others without their permission.
- Tell us at once at hello@qwikexit.com if you think someone else has used your account.
3. Shopping with scan-and-pay
3.1 Scanning and your bill
- Scan the store QR (or let the app detect the store), then scan each item's barcode. You are responsible for scanning every item you intend to take, in the right quantity.
- Prices, discounts, taxes and offers come from the store's own system. If the shelf price, MRP or label differs from the price in the app, ask a staff member before paying. Under the Legal Metrology Act, 2009 no item may be sold above its MRP; if this happens, the store will refund the difference.
- Express lanes may have an item limit set by the store (shown in the app). A store may also limit how many units of an item one shopper can buy in a day, and you can only buy what the store has in stock; the app tells you and adjusts your bag. Some items (for example age-restricted, weighed, high-value or security-tagged items) may need the store's counter or staff help.
- Coupons and offers are given by the store or brand, have their own conditions and validity, are not transferable and have no cash value.
3.2 Payment
- Payment is made through Razorpay or another RBI-authorised payment gateway the store uses (for example PayU, Paytm, Cashfree or PhonePe), by UPI, cards, net-banking, wallets or other methods it offers, into the retailer's account. Some stores also take payment at the counter or on a card machine. The gateway's terms apply to the payment. We never see or store your card, UPI PIN or bank login.
- Your purchase is complete when the payment is confirmed and you receive the receipt and exit pass. A failed payment does not complete the purchase; see the Refund & Cancellation Policy for money debited without confirmation.
- The retailer issues the GST tax invoice in its name. You can view and download it in the app under Shopping History.
3.3 Exit verification
- After paying, show the exit pass (QR) to the store staff at the exit. It is valid for a short time and can be refreshed in the app before it is used.
- Staff may count your items, check them against the receipt or ask for a fuller check, as at any store counter. Some checks are suggested by our automated risk check, but a person always decides.
- If an item was not scanned or paid for, you must pay for it or return it before leaving. If you were charged for something you are not taking, the store will correct the bill and refund the difference.
- Checks must be carried out respectfully and lawfully, under our Acceptable Use & Fair Exit Policy. Staff may not search your person or detain you; disputes are handled by the store manager and, where necessary, the police.
3.4 Staff-assisted carts
A staff member may build a cart for you and give you a Cart QR. When you scan it, those items are added to your bag and that staff member is credited. Check the items and prices before you pay.
4. Returns, refunds and cancellations
Returns and exchanges of goods follow the store's own policy and your rights under the Consumer Protection Act, 2019. Failed, duplicate and wrong payments, and the Pro plan, are covered by our Refund & Cancellation Policy.
5. Offers, follows and the Pro plan
- On the Free plan you can follow a limited number of brands and stores (the current limit is shown in the app) and see their offers. The Pro plan shows offers from every partner store and brand near you and the related alerts.
- Offers are made by retailers and brands. We do not guarantee that any offer will be available, unchanged or suitable. Offers reach shoppers within a set distance of the store (currently 50 km).
- Pro is not yet sold in the mobile apps; when it is, it will be bought through Apple App Store or Google Play billing where their rules require. Pro is a monthly subscription at the price shown in the app before you pay, including GST. It renews automatically each month through a Razorpay mandate until you cancel. Cancel any time in the app; you keep Pro until the end of the period already paid. Refunds are covered by the Refund & Cancellation Policy.
- We may change plan prices or benefits with at least 7 days' notice in the app before your next renewal; a change applies from your next renewal, and you can cancel before it does.
6. Your conduct
Use the Service lawfully and honestly, following our Acceptable Use & Fair Exit Policy. In particular, do not leave a store with goods you have not paid for, tamper with prices, barcodes, exit passes or the app, use someone else's account or payment method, or try to break or overload our systems. We may suspend or close accounts that do, and report offences to the police.
7. Intellectual property and licence
The Service, the QwikExit name and logo, our software and content belong to BharatAI Solutions Private Limited or its licensors. We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, under these Terms and the App Licence (EULA). Store names, logos and product information belong to the retailers and brands.
8. Availability and changes
We work to keep the Service available but cannot promise it will always be uninterrupted or error-free, for example during maintenance, network problems or outages of payment providers. If QwikExit is not working, you can always pay at the store's billing counter. We may change, add or remove features; we will tell you in advance about changes that materially reduce what you can do.
9. Help, complaints and grievances
For any problem with a purchase, payment, exit check, offer, your account or your data, contact us at hello@qwikexit.com. Our Grievance Officer acknowledges complaints within 24 hours and resolves them within 15 days, as required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020; see Grievance Redressal.
For problems with the goods themselves (quality, returns, warranty), the retailer is responsible, and we will pass your complaint to them and follow it up. You may also approach the National Consumer Helpline (consumerhelpline.gov.in, 1915) or a Consumer Commission.
10. Disclaimers and limits of liability
The Service is provided "as is" and "as available". To the extent the law allows, we do not give warranties beyond those stated in these Terms. The retailer, not QwikExit, is responsible for the goods, their price, quality, safety, labelling, warranty and returns.
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss caused by events beyond our reasonable control (for example outages of networks, payment systems or app stores, or natural events). Our total liability to you for any claim about the Service is limited to the greater of the amount you paid us (for Pro) in the 12 months before the claim and ₹1,000.
Nothing in these Terms limits liability that cannot be limited under Indian law, including for fraud, or your rights as a consumer under the Consumer Protection Act, 2019.
11. Indemnity
You agree to compensate BharatAI Solutions Private Limited for losses caused by your breach of these Terms, your misuse of the Service or your violation of law or of the rights of others, to the extent the law allows and the loss is caused by you.
12. Suspension, closure and account deletion
You may stop using the Service and delete your account at any time (see Account & Data Deletion). We may suspend or close your account if you seriously or repeatedly break these Terms, if we must by law, or to prevent fraud or harm. Unless the law or an investigation prevents it, we will tell you why and give you a chance to respond. Sections 7, 10, 11, 13 and 14 continue after closure.
13. Governing law and disputes
These Terms are governed by the laws of India. Please contact us first so we can try to resolve any dispute within 30 days. Subject to that, the courts at Bareilly, Uttar Pradesh have jurisdiction. This does not take away your right as a consumer to file a complaint before a Consumer Commission where you live or work, as the Consumer Protection Act, 2019 allows.
14. General
- We may update these Terms. The date at the top shows the latest version, and we will tell you in the app or by email about material changes before they take effect. Continuing to use the Service after that means you accept them.
- If any part of these Terms is found unenforceable, the rest stays in force. Not enforcing a right is not a waiver of it.
- You may not transfer your rights under these Terms. We may transfer ours to a successor of our business, with notice to you.
- These Terms, with the policies they refer to, are the whole agreement between us about the Service. If the English text and a translation differ, the English text prevails.
